DEFINITIONS

The Service Provider

Wag Society Brooklyn, and its employees, servants, or agents.

The Client

The Client is the owner, keeper, or person in charge of the animal(s) to which the services of Wag Society Brooklyn are sought.

The Pet

The Pet is the animal(s) that is the responsibility of the Client during the period when services are supplied by Wag Society Brooklyn.

The Services

The Services are the provision of care, exercising, feeding, and generally looking after the Pet(s) by Wag Society Brooklyn on behalf of the Client, generally in their absence.

Services comprise of:

  • Dog Walking (group or solo walks)

  • Dog / Cat Drop-in Visit

  • Puppy Visit

  • Dog Boarding (daytime or overnight)

  • Pet Sitting (daytime or overnight)

  • Extras (e.g., key collection/return, vet visits, administering medication, feeding fish, watering plants/gardens, shopping for supplies, additional meet & greet)

1. Services

1.1 Wag Society Brooklyn agrees to perform all services with professionalism, reliability, and compassion, exercising reasonable care and skill at all times and in accordance with the Policies & Procedures and any pertinent information provided through the Time To Pet platform.

1.2 Wag Society Brooklyn will make every reasonable effort to follow instructions submitted by the Client via the Time To Pet platform, provided those instructions align with the scope of services outlined in the Policies & Procedures.

1.3 Wag Society Brooklyn shall remain responsible for compliance with all applicable laws, regulations, bylaws, and industry standards relevant to the delivery of its services.

1.4 Wag Society Brooklyn will inform the Client of any incident involving the Pet that could reasonably be expected to lead to civil or criminal proceedings, occurring during the period the Pet is in the company’s care.

2. Client Responsibilities

2.1 The Client shall provide accurate, complete, and up-to-date information necessary for Wag Society Brooklyn to safely and effectively perform its services.

2.2 The Client authorizes Wag Society Brooklyn to access their property and carry out all scheduled services as booked through Time To Pet.

2.3 The Client affirms that all details provided to Wag Society Brooklyn are true to the best of their knowledge and will be kept current via the Time To Pet platform.

2.4 The Client confirms that their Pet is in compliance with all local laws and regulations, including but not limited to vaccinations, licensing, and health treatments.

2.5 The Client may provide reasonable instructions regarding the care of their Pet, as long as such instructions are consistent with the services offered and the terms outlined in the Policies & Procedures.

2.6 The Client shall assume responsibility for and indemnify Wag Society Brooklyn against any injuries or damages caused by the Pet to Wag Society Brooklyn staff or representatives, unless such incidents result from proven negligence on the part of Wag Society Brooklyn.

2.7 The Client authorizes Wag Society Brooklyn to seek emergency veterinary care if necessary during the course of service. Reasonable efforts will be made to obtain the Client’s prior consent.

2.8 The Client agrees to reimburse Wag Society Brooklyn for any costs incurred in connection with emergency care, including veterinary expenses and additional visits required to monitor the Pet’s wellbeing.

2.9 Where feasible, Wag Society Brooklyn will use the Pet’s regular veterinary provider. If unavailable, the Client authorizes Wag Society Brooklyn to use an alternative licensed veterinarian for any necessary treatment or intervention.

2.10 The Client shall ensure that Wag Society Brooklyn is provided with reliable access to the home or agreed-upon location during scheduled visits or appointments.

2.11 Wag Society Brooklyn is not liable for delays or failure to deliver services if the Client has not fulfilled their responsibilities as outlined in this section.

2.12 The Client shall disclose any existing civil or criminal court orders or behavioral restrictions applicable to the Pet.

2.13 The Client must ensure that all dogs are fitted with collars displaying visible identification tags with the owner’s current name and address, as required by law.

2.14 The Client agrees to confirm, in writing, when they have returned and resumed care of their Pet. In the absence of such confirmation, Wag Society Brooklyn will provide 30-minute drop-in visits to ensure the Pet’s ongoing safety and well-being. These visits will be scheduled and billed at the standard rate until written confirmation is received.

3. Fees and Payment

3.1 Wag Society Brooklyn will charge the Client for services as detailed in the Time To Pet online pet management system (“the Fees”), and the Client agrees to remit payment promptly when due.

3.2 The Client agrees to reimburse Wag Society Brooklyn for any additional fees or costs incurred while providing emergency care, including but not limited to unexpected visits, transportation, temporary housing, food, or supplies, upon presentation of a valid receipt.

3.3 If any payment remains outstanding for more than seven (7) days past the due date, Wag Society Brooklyn reserves the right to suspend services until payment is received in full.

3.4 To maintain active services, the Client is required to have a valid payment method on file. All invoices will be automatically charged to the card on file on the due date, as invoiced through the Time To Pet system. If a payment fails or an invoice remains past due, Wag Society Brooklyn reserves the right to reattempt payment and suspend services until the outstanding balance is paid in full.

3.5 All services rendered on recognized public and bank holidays are billed at an additional $15 and will be itemized on the Client’s invoice via the Time To Pet system.

4. Cancellations

4.1 In the event the Client cancels any booked, invoiced, or otherwise confirmed services, the Client agrees to pay Wag Society Brooklyn a cancellation fee as follows:

4.1.1 Dog Walking
One hundred percent (100%) of the service fee if cancellation occurs within twenty-four (24) hours of the scheduled service start time.

4.1.2 Boarding and Pet Sitting
One hundred percent (100%) of the service fee if cancellation occurs within seventy-two (72) hours of the scheduled service start time.

Fifty percent (50%) of the service fee if cancellation occurs between seventy-two (72) hours and seven (7) days prior to the scheduled service start time.

4.2 Without prejudice to Clause 9.1, if Wag Society Brooklyn must cancel or is otherwise unable to provide a scheduled service:

4.2.1 Wag Society Brooklyn will make every effort to arrange alternative care of equal value and quality; or

4.2.2 Issue a full refund for any payments received in connection with the canceled service; and

4.2.3 In either case, provide at least twenty-four (24) hours’ notice where possible, or notice as soon as reasonably practicable in the event of an emergency or sudden change.

4.3 All confirmed dog boarding and pet sitting dates are final and cannot be exchanged for alternative dates or times. If the Client wishes to change a booking, the original reservation must be canceled in accordance with this section and a new booking submitted through the Time To Pet system.

Dog walking services may be rescheduled for a different date if both parties mutually agree.

5. Early Termination

5.1 This Agreement may be terminated:

5.1.1 By either party, with no less than seven (7) days’ written notice to the other;

5.1.2 By Wag Society Brooklyn, with immediate effect, should any outstanding balance remain unpaid for more than seven (7) days; and

5.1.3 The Client shall be liable for all service fees, costs, and charges incurred through the date of termination.

6. Insurance

6.1 Wag Society Brooklyn shall maintain valid and sufficient insurance coverage at all times, including but not limited to Public Liability Insurance applicable to the services provided.

6.2 It is the Client’s responsibility to ensure that their property, its contents, and their pet(s) are adequately insured for the duration of this agreement.

7. Indemnity and Liability

7.1 Wag Society Brooklyn shall not be liable for any loss or damage suffered by the Client resulting from the Client’s failure to follow any instructions provided by Wag Society Brooklyn.

7.2 The Client shall accept full liability and responsibility for any event occurring or arising from the behavior or characteristics of their Pet.

7.3 The Client will indemnify Wag Society Brooklyn against any damage or injury caused by the Pet towards any property, person, or other animal. This includes, but is not limited to, veterinary, medical, and legal fees.

7.4 Wag Society Brooklyn shall not be responsible for any damage caused to the Client’s property or possessions, or that of others, caused by the Client’s Pet during the period the Pet is in its care. The Client agrees to indemnify Wag Society Brooklyn against any claims that may arise from such damage.

7.5 Wag Society Brooklyn accepts no responsibility or liability for the security of the Client’s property or premises, or any loss or damage that may occur due to actions taken by third parties who also have access to the Client’s property or premises, either before, during, or after the expiration of this Agreement.

7.6 Wag Society Brooklyn shall not be liable for injury, loss, death, or any actions, fines, or penalties imposed on Pets permitted unsupervised access to the outdoors.

7.7 Wag Society Brooklyn will care for the Client’s Pet as the Client would. While every effort will be made to ensure the safety and well-being of the Pet, Wag Society Brooklyn cannot be held liable for any loss, illness, or injury to any Pet in its care, nor for any death of a Pet unless Wag Society Brooklyn can be shown to be negligent.

7.8 The Client is responsible for any veterinary bills incurred while their Pets are in the care of Wag Society Brooklyn.

8. Aggressive or Unsocial Animals

8.1 Should any Pet become aggressive or dangerous, Wag Society Brooklyn shall, at its sole discretion, take whatever action it deems necessary in the best interest of the animal, other animals, or people that may be encountered. This may include, without limitation:

8.1.1 Refusal to offer the services and immediate termination of this Agreement;

8.1.2 Seeking assistance from a vet Animal Care & Control of NYC, or 311;

8.1.3 Placing the Pet in a boarding kennel.

8.2 Any fees or costs incurred in taking action under Clause 8.1 shall be directly chargeable to and recoverable from the Client.

8.3 Wag Society Brooklyn shall not be liable to the Client for any refund of fees if the Client has not specified the behavior and characteristics of the Pet in the online pet management system, and Wag Society Brooklyn has to terminate the Agreement under Clause 8.1.1.

9. Force Majeure

9.1 Neither party shall be liable for any delay or default in performing its obligations under this Agreement due to conditions beyond its control, including but not limited to acts of God, war, strikes, fires, floods, governmental restrictions, or power failures.

9.2 The Party (the “Affected Party”) prevented from carrying out its obligations due to Force Majeure shall give notice to the other Party upon becoming aware of such an event.

10. Assignment

10.1 Wag Society Brooklyn is entitled to perform any of the obligations undertaken in this Agreement through any other member of its group or through suitably qualified and skilled sub-contractors. Any act or omission by such a member or sub-contractor shall be considered an act or omission of Wag Society Brooklyn.

11. Data Protection

11.1 Wag Society Brooklyn shall not use or pass on any Client information to a third party (other than information necessary for a carer to perform their duties) except where required by law.

POLICIES AND PROCEDURES

1. Bookings

1.1 All service requests must be submitted via our booking platform, Time To Pet. A service is not considered confirmed until written confirmation is issued by Wag Society Brooklyn.

1.2 A complimentary in-home consultation is required for all new clients prior to the commencement of services. Requests for additional in-person introductions with individual walkers or follow-ups are subject to additional fees. Meet and greets exceeding 30 minutes will be billed as a 15-minute Drop-In Visit at the current rate of $20.

1.3 Same-day or next-day bookings may be accepted based on availability but could be subject to a rush fee.

1.4 Time windows selected in Time To Pet are approximate. Delays may occur due to weather, traffic, or unforeseen delays.

2. Duty of Care

2.1 Transitioning a pet from its normal routine may cause stress. Wag Society Brooklyn is committed to offering comfort and continuity of care. To support this, clients are required to maintain accurate, up-to-date care details within their Time To Pet profile.

2.2 In the event of extreme weather conditions (e.g., heat advisories, thunderstorms, snowstorms), Wag Society Brooklyn may alter or postpone outdoor services at its sole discretion to ensure pet safety.

2.3 Staff members are trained to respond to changes in a pet’s behavior and will notify the client if any unusual signs are observed. Wag Society Brooklyn reserves the right to make real-time care decisions in the best interest of your pet.

3. Communication and Updates

3.1 Daily visit updates, including summaries and photos, will be delivered through the Time To Pet platform once care is completed and it is safe and appropriate to do so.

3.2 Wag Society BK may use photos and non-identifying media content captured during care for marketing or social media purposes unless the client opts out in writing.

4. Supplies and Equipment

4.1 Clients must provide all necessary supplies, including but not limited to: food, medications, litter, waste bags, cleaning products, leashes, harnesses, and ID tags.

4.2 For all public walks, dogs must wear secure collars or harnesses with identification tags as required by New York City regulations.

4.3 Wag Society Brooklyn is not responsible for damage to or loss of personal items not secured or stored properly.

5. Home Cleanliness

5.1 Wag Society Brooklyn will clean up after pets to the best of our ability during scheduled services.

5.2 Clients must provide access to appropriate cleaning materials and specify their location in Time To Pet profile.

5.3 We are not responsible for damage, staining, or odor resulting from pet accidents or cleanup efforts conducted in good faith.

6. Access and Key Management

6.1 Clients must provide a set of full working keys or a secure digital access method.

6.2 All keys are stored securely, coded internally, and never labeled with identifiable information.

6.3 Key pickup or return outside of active service windows may incur an additional fee.

6.4 Keys will only be returned after all outstanding balances have been settled.

6.5 Clients are responsible for ensuring all access and alarm instructions are accurate and up to date within Time To Pet.

7. Health, Medication, and Emergencies

7.1 Clients must disclose all medical conditions, allergies, and behavioral concerns via Time To Pet prior to service.

7.2 Wag Society Brooklyn will administer medication as instructed but assumes no liability for complications resulting from undisclosed information or medication side effects.

7.3 In the event of illness or injury, and if the client cannot be reached promptly, Wag Society Brooklyn reserves the right to seek veterinary care at the client’s expense.

7.4 Pets displaying symptoms of contagious illness may be refused service. The client may also be liable for costs associated with any transmission to other animals.

8. Pet Behavior and Safety

8.1 Wag Society Brooklyn reserves the right to refuse or terminate service if a pet exhibits unsafe, aggressive, or disruptive behavior.

8.2 Dogs in heat and unneutered males are not eligible for group walks. Solo walks may be arranged, subject to availability and billed at the solo service rate.

8.3 All dogs will be walked on-leash.

9. Security and Surveillance

9.1 Clients must disclose the presence of any cameras (internal or external) in Time To Pet. Undisclosed monitoring may result in immediate service termination.

9.2 Clients are responsible for providing all security system access information. Failure to do so may result in missed or incomplete services, for which the client remains financially responsible.

9.3 Wag Society Brooklyn is not responsible for security breaches, false alarms, or issues resulting from incomplete or inaccurate home access details.

10. Additional Services and Fees

10.1 Additional services such as errands, vet transport, key delivery, or plant care may be arranged and are subject to standard add-on rates.

10.2 Rush booking fees, cancellation charges, and holiday surcharges are outlined in the Wag Society Brooklyn fee schedule.

11. Insurance and Liability

11.1 Wag Society Brooklyn is insured and bonded. However, we are not liable for damage to property, pets, or personal belongings due to pre-existing conditions, pet behavior, or third-party activity.

11.2 Clients are encouraged to notify their homeowner’s or renter’s insurance provider that a pet care professional will have access to their property during their absence.

12. Privacy and Data

12.1 Client and pet information will be used solely for service provision and never sold or shared. Additional information can be found outlined in our privacy policy.

13. Third Parties

13.1 Clients must inform Wag Society Brooklyn in Time To Pet if anyone else will have access to the property during the service period (e.g., family, cleaners, contractors).

13.2 Wag Society Brooklyn is not liable for any acts, omissions, or security breaches involving third parties.

13.3 Services may be paused or rescheduled if our care team arrives to find unreported individuals on-site.

14. Pet Specifics

14.1 Dogs

14.1.1 Group Walks

Wag Society Brooklyn offers group dog walks Monday through Friday, excluding weekends and recognized public holidays. Each group walk is limited to a maximum of four dogs per caregiver to ensure safety and personalized attention; group sizes are subject to availability. Group walk time windows are as follows:

  • Morning: approximately 10:00 AM – 11:00 AM

  • Midday: approximately 12:00 PM – 2:00 PM

  • Afternoon: approximately 3:00 PM – 5:00 PM

Dogs who are ineligible for group walks—due to behavioral concerns, aggression, being in heat, not being neutered, illness, or other factors—may be offered a solo walk, subject to availability and billed at the published solo rate.

14.1.2 Solo Walks

Any walk scheduled outside of the standard group walk windows, or requested for reasons including but not limited to a pet’s temperament, preferences, schedule, or specific care needs, will be considered a solo walk and charged at the published solo rate.

14.1.3 Leash Policy

For the safety of all pets and staff, dogs will remain on-leash at all times during walks.

14.1.4 Pick-Up and Drop-Off

To minimize disruption and maintain efficient routes, pick-up and drop-off times for group walks are kept as brief as possible. Caregivers adhere to a strict two-minute entry policy when collecting or returning pets inside a client’s home.

14.2 Cats

14.2.1 Outdoor Access

Wag Society Brooklyn is not responsible for the welfare of cats that have unsupervised outdoor access via a cat flap or any other exit point while the client is away.

14.2.2 Home Security

It is the client’s responsibility to ensure that all entry points—such as windows and cat flaps—are secured if they do not wish their cat(s) to have outdoor access during their absence. Wag Society Brooklyn will follow instructions provided in Time To Pet but is not liable for any consequences resulting from unsecured exits.
